Kenya legal rules for betting and use
WinWin Terms and Conditions govern your registration, account use, betting, and access to services in Kenya. By visiting the official website or mobile app, you agree to the legal rules described here. The requirements apply to every user located in Kenya who places a bet or uses bonuses. Compliance is guided by Kenyan law and directions of relevant regulators.
General terms of use and user rights
By creating an account on WinWin, you accept these Terms and Conditions, the Privacy Policy, the Responsible Gambling policy, and any sport- or game-specific rules. You should read all policies before registration or placing bets.
- Eligibility and access
- You confirm you are at least 18 years old and are not prohibited from betting by Kenyan law.
- You agree to use the platform only for lawful purposes and not on behalf of anyone else.
- Only one account is allowed per person, household, payment instrument, and device, unless we approve otherwise.
- Changes to terms
- WinWin may update these terms to meet legal or operational requirements. Updates take effect when posted on the website or app. Continued use means you agree to the revised terms.
- Proper platform use
- You will not misuse services, attempt unauthorised access, deploy bots or scripts, manipulate odds, or engage in arbitrage or match-fixing.
- You will keep your login details confidential and accept responsibility for activity under your account.
- Content and intellectual property
- All site content, data, odds displays, trademarks, software, and materials are protected by intellectual property laws. You may not copy, scrape, or redistribute content without written permission.
- Bonuses and promotions
- Any bonus, free bet, or promotion is governed by specific bonus terms. Wagering requirements, expiry periods, market restrictions, and eligibility rules apply.
- Liability and disclaimers
- Services are provided on an as-available basis. To the extent permitted by Kenyan law, we are not liable for indirect or consequential loss, loss of profits, or losses caused by network outages, third-party failures, or events outside our control.
- Nothing in these terms limits your statutory rights under Kenyan law or our liability for fraud or gross negligence.
- Governing law and regulator
- These terms are governed by the laws of Kenya, including the Betting, Lotteries and Gaming Act, and oversight by the relevant authorities such as the Betting Control and Licensing Board.
- Contact and notices
- Notices will be provided through the website, app, or your registered email/SMS. You should keep your contact information up to date.
General betting rules for events and odds
- Who may place bets
- You must be 18+ and located in Kenya at the time of placing a bet.
- Employees, contractors, and individuals connected to an event (athletes, officials, data providers) are not allowed to bet on that event.
- Bet acceptance
- A bet is accepted when a confirmation appears in your bet history and a reference ID is issued. Pending or processing states are not accepted bets.
- Pre-match bets placed after an event has started are void unless listed as live markets.
- We may reject or limit bets before acceptance, correct obvious pricing errors, or void markets affected by technical faults.
- Minimum/maximum stakes and payout caps
- Minimum and maximum bet amounts are shown on the betslip and may vary by market.
- Maximum payouts per bet, market, or day may apply as displayed in the rules section or betslip.
- Odds and settlement
- Decimal odds are used unless stated otherwise. Returns are calculated as stake multiplied by odds, less applicable taxes or duties.
- For multiples, void selections settle at odds of 1.00. Settlement relies on official results or trusted data sources. If an official result changes later, settlement usually stands based on the first official result unless market rules specify otherwise.
- Event changes, postponements, and cancellations
- If an event is postponed or abandoned, markets may remain open or be voided according to market-specific rules published for that event.
- Where a market specifies a time window for completion (for example, within a set number of hours), bets may be void if not completed in that window.
- Cash out and edits
- Cash out or bet edit features are offered at our discretion and may be unavailable during suspensions, price updates, or technical issues. Any cash out value is an offer and not guaranteed until confirmed.
- Restrictions and prohibited activity
- Syndicate betting, bonus abuse, use of automated betting tools, or placing bets contrary to market integrity principles is prohibited.
- We may suspend or close accounts, void bets, and report suspected match-fixing or illegal activity to relevant authorities.
- Taxes and statutory charges in Kenya
- Excise on stakes and withholding tax on winnings apply at statutory rates. Deductions will appear on the betslip or statement in line with Kenyan law.
- Cancellations and errors
- Once accepted, a bet cannot be cancelled by you. If a palpable error in odds or settlement is identified, we may correct or void the affected bet in accordance with applicable rules.
Payment rules for deposits and withdrawals
- Funding your account
- Supported methods may include mobile money (such as M-Pesa), bank transfer, and cards, subject to availability in Kenya.
- The payment instrument must be registered in your name. Third-party deposits are not allowed.
- Minimum and maximum deposit limits are shown in the cashier. Network or processing fees may apply and will be shown where possible.
- Withdrawals
- Withdrawals are generally sent to the original funding method and to the same name as the account holder.
- Processing times: mobile money is usually credited within minutes to 24 hours; bank transfers may take 1–3 business days, subject to verification and bank schedules.
- We may combine multiple withdrawal requests or set daily limits for security and compliance.
- KYC/AML checks
- Before withdrawals, we may request: Kenyan ID or passport, a selfie, and proof of address (utility bill, bank statement), and proof of source of funds where required.
- Name and identity must match your account. Inconsistent details may lead to delays or rejection.
- Fees, duties, and taxes
- Service providers may charge transaction fees. Excise on stakes and withholding tax on winnings are deducted as required by Kenyan law.
- Transaction restrictions
- We may suspend deposits or withdrawals pending security reviews, affordability checks, or regulatory requests.
- Chargebacks are prohibited. Unauthorised chargebacks may result in account restriction and recovery of costs.
- Cancellation and reversals
- Deposits generally cannot be cancelled once successful. Where a reversal is permitted, it is subject to AML review and any applicable processing fees.
- Withdrawals can be cancelled by you only before processing starts, if the cashier provides that option.
- Bonus funds
- Bonus credits and free bets are not withdrawable until wagering requirements are met. Attempts to withdraw bonus funds in breach of bonus terms may result in bonus removal and associated bet cancellations.
- Records
- You can read your full transaction history in your account statement. Keep personal records for tax and budgeting purposes.
Responsible betting and safer play tools
Responsible betting protects you and supports sustainable play. The following controls are available and may be managed in account settings:
- Limits and controls
- Deposit, loss, and stake limits per day, week, or month.
- Reality checks and session reminders to review your betting activity.
- Time-out (24 hours to 30 days) and self-exclusion (6 months or longer). Decreases to limits take effect immediately; increases apply after a cooling-off period.
- Self-assessment
- A risk self-assessment tool may help you read patterns in your behaviour, including chasing losses, betting beyond your means, or neglecting responsibilities.
- Support resources in Kenya
- Betting Control and Licensing Board public resources on safer betting.
- NACADA for addiction support information.
- Gambling Therapy (online) and GamCare for counselling and live chat support.
- Protecting minors
- Betting is not allowed for persons under 18. Keep devices secure and use content filters to prevent underage access.
- Affordability and cooling-off
- Only bet money you can afford to lose. Consider lowering limits or taking a break if betting affects your finances or wellbeing.
- Account actions
- We may apply mandatory limits, suspend activity, or provide referrals if harmful use is identified.
Anti-money laundering (AML) and KYC in Kenya
We operate under Kenyan laws, including the Proceeds of Crime and Anti-Money Laundering Act and related regulations. Our programme aims to prevent money laundering and terrorism financing.
- KYC identification
- We verify identity, age, and address before permitting withdrawals or where risk thresholds are reached. Enhanced due diligence applies to higher-risk customers, transactions, or geographies.
- Transaction monitoring
- Automated and manual controls monitor deposits, bets, withdrawals, and bonuses to detect unusual patterns, rapid in-and-out movement of funds, structuring, or third-party payments.
- Sanctions and PEP screening
- Screening is performed against applicable sanctions lists and for politically exposed persons. Additional checks may be required for PEPs and their close associates.
- Source of funds/wealth
- We may request documents to evidence income or source of funds before processing transactions.
- Reporting and cooperation
- Suspicious Transaction Reports may be filed with the Financial Reporting Centre. We cooperate with lawful requests from Kenyan authorities.
- Consequences of breaches
- We may delay, restrict, or block transactions, freeze balances, suspend or close accounts, and retain funds as required by law. Attempts to bypass controls may be reported to authorities.
